General terms and conditions

These conditions clearly explain which agreements apply when Mondzorg Koningstraat accepts you as a patient and provides dental care.

1. Applicability

These general terms and conditions apply to every medical treatment agreement and every related agreement between Mondzorg Koningstraat, hereinafter “the practice”, and the patient. Statutory patient rights, including the rights under the WGBO, always remain applicable and take precedence in the event of conflict.

The conditions are made available digitally before or upon entering into the treatment agreement and can be stored. A registration form or intake request does not mean that the practice has accepted the patient.

2. Intake and conclusion of treatment agreement

During the first intake, the practice assesses oral health, care needs and whether the required care can be responsibly offered within the practice. The practice discusses the outcome with the patient.

The treatment agreement is created when the practice accepts the patient and the parties make agreements about the care. If the practice cannot provide appropriate care, it will explain this if possible and advise on an appropriate next step or referral.

3. Information and consent

The practice informs the patient in a comprehensible manner about the examination, the proposed treatment, reasonable alternatives, relevant risks, the expected consequences and the costs. The patient decides together with the practitioner and can refuse or withdraw consent.

Permission is requested for transactions in accordance with the applicable laws and regulations. For minors, the legal rules regarding consent and information apply to the child and the parent or guardian.

4. Patient Obligations

The patient provides timely, complete and accurate information that is reasonably necessary for safe care, including relevant medical information, medication use and changes in health. The patient cooperates with the treatment to the best of his ability and follows reasonable advice.

Changes to contact, insurance or personal data will be communicated to the practice as soon as possible.

5. Treatment plan, rates and budget

The practice uses the applicable services and maximum rates of the Dutch Healthcare Authority, except where legally free rates apply. Reimbursements depend on the patient's policy; the patient remains responsible for checking the reimbursement.

For a treatment with expected costs above €250, the practice provides a budget in advance. Above €500, this budget will be provided in writing. If the treatment plan changes or unforeseen circumstances arise, the practice will discuss the consequences and any additional costs as soon as possible.

6. Appointments, cancellations and no-shows

The patient cancels or reschedules an appointment as early as possible using the practice's contact details. In the event of no cancellation or late cancellation, the practice may charge a reasonable no-show fee directly to the patient, but only if the patient has been informed in advance about the arrangement and the applicable amount. A no-show amount cannot be declared to the health insurer.

The practice takes demonstrable force majeure into account. The practice may move an appointment if this is necessary for good and safe care and will inform the patient as soon as possible.

7. Payment

The patient is responsible for paying for care that is not reimbursed by the health insurer. Invoices can be submitted directly or via an invoicing or factoring service. The payment term is stated on the invoice.

In the event of late payment, the patient will first receive a free reminder with the legally required term. Only then can statutory interest and extrajudicial collection costs become due. A substantive question about an invoice will be reported to the practice as quickly as possible.

8. File, privacy and confidentiality

The practice maintains a medical file and treats medical data confidentially. The legal retention period for the medical file is in principle twenty years from the last change, or longer if required by law or good care.

9. Termination and Referral

The patient can terminate the treatment agreement. The practice only terminates this for important reasons and with due observance of professional care, including timely communication, necessary care in the transition period and cooperation in file transfer with valid consent.

10. Liability

The practice is liable for damage to the extent this follows from the law. Nothing in these terms and conditions limits any liability that may not be lawfully excluded. The patient reports possible damage as soon as possible so that the situation can be carefully investigated.

11. Complaints and disputes

A complaint is preferably first discussed with the practitioner or practice. The patient can request help free of charge from the independent complaints officer with which the practice is affiliated. The practice will immediately provide current contact details upon request.

If a complaint is not resolved, the patient can turn to the recognized dispute resolution body to which the practice is affiliated. More information can be found in the complaints procedure. The legal options, including the civil court and where applicable disciplinary law, continue to exist.

12. Changes and Applicable Law

The practice may change these conditions for future agreements. The applicable version will be clearly made available before it becomes applicable. Dutch law applies to the treatment agreement. Disputes will be handled by the competent authority according to law.
